Terms of Service
License to Use Services
Subject to your compliance with this Agreement, Breadcrumbs grants you a limited, non-exclusive, non-transferable, revocable license to access and use Breadcrumbs Services for your personal, non-commercial use.
Restrictions on Use
You may not use Breadcrumbs services for any illegal or unauthorized purpose. You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, works of authorship, applications, links, and other content or materials that you submit, post, or display on or through Breadcrumbs services.
Intellectual Property Rights
Breadcrumbs services and all rights, title, and interest in and to the services, including without limitation all intellectual property rights, are and will remain the exclusive property of Breadcrumbs and its licensors.
Disclaimer of Warranties
Breadcrumbs services are provided "as is" and "as available" without any warranties of any kind, whether express, implied, statutory, or otherwise. Breadcrumbs makes no representations or warranties of any kind, including without limitation as to the accuracy, completeness, reliability, availability, suitability, or operation of the Service.
Limitation of Liability
In no event will Breadcrumbs or its affiliates, licensors, or suppliers be liable for any damages of any kind arising from or in connection with your access to or use of Breadcrumbs services, including without limitation any direct, indirect, incidental, consequential, punitive, or other damages, even if Breadcrumbs has been advised of the possibility of such damages.
Termination
Breadcrumbs may terminate this agreement and your access to Breadcrumbs services at any time, for any reason or no reason, without notice to you.
Prohibited Activities
You may not use Breadcrumbs services to engage in any activities that are malicious or harmful to Breadcrumbs or any third party, including without limitation:
using Breadcrumbs services to violate the rights of any third party, including without limitation intellectual property, privacy, or publicity rights;
intentionally submitting or transmitting incorrect or excessive configurations or requests that may impair the performance or availability of Breadcrumbs services;
using Breadcrumbs services in any way that could damage, disable, overburden, or impair the Service or interfere with any other party's use of Breadcrumbs services; or
using Breadcrumbs services in any way that constitutes a violation of this agreement or any applicable laws or regulations.
Breadcrumbs reserves the right to monitor, investigate, and take appropriate action against any violations of this section, including without limitation terminating or suspending your access to the Service. You are solely responsible for your actions and any consequences arising from your use of the Service.
Changes to Services
Breadcrumbs reserves the right to make changes to any Breadcrumbs service, including without limitation adding or removing features, suspending or discontinuing the service, and modifying the terms of this agreement. You are responsible for regularly reviewing this agreement to stay informed of any changes. Your continued access to or use of the service after any changes are made to this agreement constitutes your acceptance of those changes.
User Accounts
If you create an account on any Breadcrumbs service, you are responsible for maintaining the security of your account. You must be 13 years of age or older to create an account. If you are a minor, you may only do so with parental or adult supervision. You may not share your account with any other person and you may not use anyone else's account.
Indemnification
You agree to indemnify Breadcrumbs and its affiliates, licensors, and suppliers for any claims arising from or in connection with your use of the Service, including without limitation any claims arising from your breach of this agreement or your violation of any rights of any third party.
Severability
If any part of this agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Governing Law and Jurisdiction
This agreement is governed by the laws of Scotland, without giving effect to any principles of conflicts of law. Any disputes arising from or in connection with this agreement will be resolved in the Scottish Courts.
Survival
The provisions of this agreement relating to your indemnification and the governing law and jurisdiction will survive the termination of this agreement.
By accessing or using Breadcrumbs services, you signify that you have read, understood, and agree to be bound by this agreement.
